ACS CAN Files Comments on Health Premium Subsidies

The American Cancer Society Cancer Action Network today filed comments with the Internal Revenue Service on the proposed rule on health premium subsidies under the Affordable Care Act. The comments address the ACA provision that makes certain people with health coverage through their employer eligible to switch to a plan in a health exchange, where they would receive subsidies to help pay their premiums. The ACA makes the premium subsidy available to people whose family income is 100-400 percent of the federal poverty level who do not have access to minimum essential coverage. The provision applies specifically to people who pay more than 9.5 percent of household income for employer coverage.

The proposed rule ties the employee contribution to the cost of an individual plan, raising concerns that people buying a more expensive family plan could pay more than 9.5 percent of household income for coverage but be ineligible for premium subsidies. ACS CAN is urging that eligibility for premium subsidies be based on the coverage -- individual or family -- sought by the employee, not merely the premium cost of an individual policy.
